AI Act
The AI Act is Regulation (EU) 2024/1689 on artificial intelligence. Obligations depend on an organisation's role, the model or system and its intended use. An IT department buying access to an API, integrating a model into a product or supplying its own system should first establish which role it occupies.
Assess the use case
The regulation prohibits certain practices and classifies some uses, including certain recruitment tools, as high-risk. Other systems face transparency requirements. Conditions and exceptions matter: the commercial label 'AI assistant' does not establish the classification. The Commission provides an overview and implementation timeline.
For a candidate-screening application, IT and HR teams should document the purpose, affected people, data, supplier responsibilities and proposed human oversight. An internal document assistant involves a different assessment, but data protection and security requirements still need attention.
Application dates
The regulation entered into force on 1 August 2024. Initial prohibitions and AI literacy provisions applied from February 2025; general-purpose model obligations from August 2025, subject to transitional arrangements. The general application date was 2 August 2026.
Following the 2026 amendments, the Commission identifies 2 December 2027 for Annex III high-risk uses and 2 August 2028 for relevant systems embedded in regulated products. Work for an IT department
- Inventory uses, models, versions, suppliers and accountable owners.
- Retain evidence supporting classification and operating decisions.
- Plan contextual testing, effective oversight and incident handling.
- Train people according to their tasks and exposure to risk.
These activities organise implementation; they are not a complete compliance test. A supplier contract does not remove the need to examine the customer's responsibilities.
Sustainable IT implications
AI codes of conduct and practice encompass different instruments. Article 95 includes voluntary environmental and inclusive-design objectives. An IT team might measure energy demand, compare a simpler solution and test accessibility. Keep such commitments distinct from the legal duties applying to the specific system.
